Important information about participation in adventure, outdoor, transport and travel services coordinated by Silver Firs.
This document supplements the Silver Firs Booking Terms and the booking-specific conditions supplied with your confirmation. It does not remove any rights or liabilities that cannot lawfully be excluded.
1. Scope and acceptance
This risk acknowledgement applies to every person who books, attends or participates in an excursion, activity, transfer, tour or related service arranged through Silver Firs. Participation confirms that the guest has read and understood this document. Where a separate signed operator waiver is required, that document must also be completed before the activity.
2. The role of Silver Firs
Silver Firs designs journeys and coordinates selected independent service providers. Unless your written confirmation expressly states otherwise, the named provider operates the activity and controls its guides, drivers, pilots, boats, vehicles, horses, equipment, route and on-the-day safety decisions. The provider’s own participation rules and waiver may apply in addition to this document.
3. Recognition of inherent risks
Outdoor and travel activities involve risks that cannot be removed completely, even when qualified providers use reasonable precautions. Depending on the confirmed service, risks may include:
- uneven, steep, wet, icy or unstable terrain; rocks, trees, cliffs, caves and limited visibility;
- rivers, lakes, sea conditions, currents, cold water, changing water levels and the risk of drowning;
- weather changes, heat, cold, wind, lightning, snow, reduced visibility and delays;
- falls, collisions, capsizing, equipment failure and contact with vehicles, boats, ATVs, snowmobiles, horses, ziplines or other participants;
- physical exertion, fatigue, altitude, dehydration, allergic reactions, illness or aggravation of an existing medical condition;
- wildlife, insects, plants, food, beverages and alcohol;
- road conditions, traffic, remote locations, delayed emergency response and limited mobile coverage; and
- acts or omissions of other participants and independent third parties.
Possible consequences include property damage, financial loss, delay, illness and physical injury. In serious cases, an incident may result in permanent disability or death. By choosing to participate, the guest knowingly accepts the ordinary and inherent risks of the confirmed activity.
4. Health, fitness and disclosure
Each guest is responsible for deciding whether the activity is suitable for them and for obtaining medical advice when appropriate. Before confirmation and again before participation, guests must disclose information reasonably relevant to safety, including age, pregnancy, injuries, allergies, medication, medical or mobility conditions, swimming ability, height, weight, fitness and previous experience.
A guest must not participate while affected by alcohol, illegal drugs or any substance that impairs judgement, balance or physical control. The operator may refuse or stop participation when information is incomplete, requirements are not met, or the guest appears unfit or unsafe.
5. Instructions and equipment
Guests must attend safety briefings, follow the operator’s instructions, remain within the authorised route and use required safety equipment correctly. Guests must not misuse equipment or act in a way that endangers themselves, other participants, staff, wildlife or property. Deliberate or reckless conduct may result in removal without a refund, subject to applicable law and the confirmed booking terms.
6. Weather, routes and operational decisions
Weather, water, trail, traffic, access and operational conditions may require a route, schedule, meeting point, vehicle or activity to change. The delivering operator makes the final safety decision. Available rescheduling, alternatives, cancellation charges and refunds are governed by the written terms accepted for the booking and the Silver Firs Cancellation Policy.
7. Independent providers and transport
Accommodation, restaurants, transport companies, activity operators, parks and other suppliers are independent organisations unless stated otherwise in writing. Guests must comply with their reasonable rules. Silver Firs is responsible for its own coordination obligations but does not take operational control of services delivered by independent providers.
8. Emergency assistance and medical costs
In an emergency, Silver Firs or the operator may contact emergency services and provide information reasonably necessary to assist the guest. Rescue, evacuation, treatment, repatriation and related transport may involve significant costs and may be delayed by location, terrain or weather. The guest remains responsible for costs not covered by the responsible provider or their insurance, subject to applicable law.
9. Travel insurance
Guests are strongly advised to hold travel insurance valid for Montenegro and specifically covering every planned activity, medical treatment, mountain or water rescue where relevant, cancellation, personal belongings and repatriation. Standard policies may exclude adventure sports or motorised activities, so coverage should be checked before payment.
10. Personal belongings
Guests remain responsible for passports, money, phones, cameras, clothing and other belongings. Water, dust, vibration, weather and physical activity may damage personal items. Any responsibility for loss or damage is determined under applicable law and the accepted booking-specific terms.
11. Children and other dependants
A parent or legally authorised guardian must provide accurate details and accept the participation conditions for a minor. The guardian confirms that they have authority to do so and must supervise the child whenever the operator requires it. Age alone does not establish suitability; height, weight, confidence, experience, equipment fit and current conditions may also be considered.
12. Liability and legal rights
To the fullest extent permitted by applicable law, each party is responsible for loss, damage or injury caused by its own acts or omissions. Silver Firs is not responsible for an inherent risk voluntarily accepted by a participant or for an independent provider’s conduct where the law does not impose responsibility on Silver Firs.
Nothing in this document excludes or limits liability that cannot legally be excluded or limited, including any applicable liability for fraud, wilful misconduct, gross negligence, death or personal injury where exclusion is prohibited, or mandatory consumer rights.
13. Photographs and recordings
Participation does not automatically grant Silver Firs permission to use an identifiable guest’s image for advertising. Where promotional use is intended, consent will be requested separately. Guests should tell the guide if they do not wish to appear in casual group photographs, while understanding that Silver Firs cannot control images independently taken by other guests in public places.
14. Governing law and disputes
This document is governed by the laws of Montenegro, subject to any mandatory consumer protection rules that apply to the guest. The parties should first attempt to resolve concerns in writing. Any court jurisdiction clause applies only to the extent permitted by applicable law.
15. Severability and relationship to other terms
If a provision is found invalid or unenforceable, the remaining provisions continue to apply. This waiver should be read with the Booking Terms, Cancellation Policy, booking confirmation and any operator-specific conditions. For the particular service, the written booking confirmation identifies the applicable provider and operational terms.
16. Confirmation
By booking or participating, the guest confirms that they have had the opportunity to read this document, ask questions and provide relevant personal information. If anything is unclear, contact Silver Firs before payment or participation.
